1. Acceptance of Terms
By accessing and using the Zamia Africa website and services, you accept and agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our services.
2. Booking and Reservations
2.1 Booking Process
- All bookings are subject to availability and confirmation
- A booking is confirmed only when you receive written confirmation from us
- We reserve the right to refuse any booking at our discretion
- You must provide accurate and complete information when making a booking
2.2 Payment Terms
- A deposit of 30% is required to confirm your booking
- Full payment must be received at least 60 days before departure
- Bookings made within 60 days of departure require full payment at time of booking
- All prices are quoted in USD unless otherwise stated
- We accept major credit cards, bank transfers, and other approved payment methods
3. Cancellation and Refund Policy
3.1 Cancellation by Client
- More than 90 days before departure: Full refund minus 10% administrative fee
- 60-90 days before departure: 50% refund of total cost
- 30-59 days before departure: 25% refund of total cost
- Less than 30 days before departure: No refund
3.2 Cancellation by Zamia Africa
We reserve the right to cancel any trip due to insufficient bookings, force majeure, or other circumstances beyond our control. In such cases, you will receive a full refund or the option to reschedule.
4. Changes and Modifications
4.1 Changes by Client
- Changes to bookings are subject to availability and may incur fees
- Name changes may be permitted with at least 30 days notice (fees apply)
- Date changes are treated as cancellations and rebookings
4.2 Changes by Zamia Africa
We reserve the right to make minor changes to itineraries due to operational requirements, weather conditions, or other unforeseen circumstances. Major changes will be communicated to you promptly.
5. Travel Documents and Requirements
- You are responsible for ensuring you have valid passports, visas, and other required documents
- Passports must be valid for at least 6 months beyond your return date
- You must comply with all health requirements, including vaccinations
- We recommend obtaining comprehensive travel insurance
- Failure to have proper documentation may result in denied boarding with no refund
6. Travel Insurance
We strongly recommend that all travelers purchase comprehensive travel insurance covering:
- Trip cancellation and interruption
- Medical expenses and emergency evacuation
- Lost or damaged baggage
- Personal liability
Zamia Africa is not responsible for any costs arising from cancellation, medical emergencies, or other unforeseen circumstances.
7. Health and Safety
- You must inform us of any medical conditions, disabilities, or dietary requirements
- You are responsible for ensuring you are medically fit to travel
- You must follow all safety instructions provided by guides and staff
- We reserve the right to refuse participation if you pose a risk to yourself or others
- Wildlife safaris involve inherent risks; you participate at your own risk
8. Liability and Indemnification
8.1 Limitation of Liability
Zamia Africa acts as an agent for hotels, airlines, transportation companies, and other service providers. We are not liable for:
- Acts or omissions of third-party service providers
- Personal injury, illness, or death
- Loss or damage to personal property
- Delays, cancellations, or changes to services
- Force majeure events (natural disasters, political unrest, etc.)
8.2 Indemnification
You agree to indemnify and hold Zamia Africa harmless from any claims, damages, or expenses arising from your violation of these terms or your conduct during the trip.
9. Conduct and Behavior
We expect all travelers to:
- Behave respectfully toward guides, staff, other travelers, and local communities
- Comply with local laws and customs
- Respect wildlife and natural environments
- Not engage in illegal activities or behavior that disrupts the trip
We reserve the right to remove any traveler from a trip for misconduct, with no refund.
10. Photography and Marketing
By participating in our tours, you grant Zamia Africa permission to use photographs or videos taken during the trip for marketing and promotional purposes, unless you opt out in writing.
11. Complaints and Disputes
If you have any complaints during your trip, please inform your guide or tour leader immediately so we can address the issue. Post-trip complaints must be submitted in writing within 30 days of trip completion.
All disputes will be governed by the laws of Tanzania and subject to the exclusive jurisdiction of Tanzanian courts.
12. Force Majeure
Zamia Africa shall not be liable for failure to perform any obligation due to causes beyond our reasonable control, including but not limited to:
- Natural disasters (earthquakes, floods, etc.)
- War, terrorism, or civil unrest
- Pandemics or health emergencies
- Government actions or travel restrictions
- Strikes or labor disputes
13. Intellectual Property
All content on our website, including text, images, logos, and design, is the property of Zamia Africa and protected by copyright and trademark laws. You may not use, reproduce, or distribute our content without written permission.
14. Privacy
Your use of our services is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information.
15. Amendments
We reserve the right to amend these Terms and Conditions at any time. Changes will be posted on this page with an updated "Last Updated" date. Continued use of our services constitutes acceptance of the revised terms.
